About these terms

These Terms of Service apply to your use of the Tiny Pine Haven website and to any purchase you arrange with us. "We" and "us" mean Tiny Pine Haven, 146 Tanakachō Hondōri, Tokamachi, Niigata 948-0028, Japan. By using the site, or by asking us to supply an item, you agree to these terms. If you do not agree with them, please do not use the site or place an order.

Using the website

The website is open to anyone who uses it lawfully. Please do not try to damage the site, gain unauthorised access to it, send automated or harmful requests, upload malicious code, or use it to harass or deceive us or another visitor.

We may change, pause or remove any part of the website at any time, for example to correct an error, update a description or carry out maintenance. We take reasonable care to keep the site available but do not promise that it will always be free from interruptions or errors.

Our content

The text, layout and design of this website belong to Tiny Pine Haven. Some photographs on the site are stock images used to illustrate the style of the collection; they belong to their respective photographers and are used under the licence terms of the source from which they were taken. You may view and print pages for your own personal use, but you may not copy, republish or sell our content without our written permission.

Items, descriptions and prices

Our collection currently consists of leggings, a sports bra, a long-sleeve top, a matching set and a jumpsuit for Pilates, stretching and everyday wear. We describe each item as accurately as we can, but because colours differ between screens and the images on this site are for illustration, please ask us for measurements, fabric details and photographs of the specific item before you decide.

Prices on the website are shown in US dollars. The amount you pay, the currency in which you pay it, any consumption tax and the shipping cost are confirmed in writing before an order is accepted, and you are not bound to buy until you have seen the final total and have agreed to it. We may correct a price that was published by mistake before an order is confirmed.

How an order works

There is no automatic checkout on the website. To order, use the contact form, call or email us with the item, the size and your delivery address. We reply with availability, the total price, the delivery cost and the expected delivery time. A contract is made only when we confirm your order in writing and you have agreed to the total, or when payment has been made on those terms, whichever comes first.

We may decline or cancel an order, for example if an item is out of stock, if the details you gave are incomplete, or if we suspect misuse. If we cancel after you have paid, we refund the full amount you paid.

Payment

We tell you which payment methods are available at the time we confirm your order, and we accept payment only through the method we confirm to you. Payment is due as stated in that confirmation. We never ask you to pay by sending card numbers through the contact form or ordinary email.

Delivery

The delivery address, carrier, delivery cost and expected delivery time are stated in our order confirmation. Delivery times are estimates. Weather, natural disasters, carrier delays or customs procedures may cause delays that are outside our control; if a delay becomes long we will tell you, and you may cancel an undelivered order for a full refund. Risk in the item passes to you when it is delivered to the address you gave us.

Returns, exchanges and refunds

Returns, exchanges and refunds are governed by our Return & Refund Policy, which forms part of these terms. In short, you may return an unused item in its original condition within 14 days of receiving it; we pay return postage when an item is faulty or not what you ordered; and we refund to your original payment method after the returned item reaches us and has been checked. Nothing in these terms limits any rights you have under Japanese consumer law, including rights in respect of defective items.

Disclaimer

Except where the law does not allow it, the website and its content are provided "as is". We do not promise that the website will be uninterrupted or error-free. Activewear is suited to moderate activity such as Pilates and stretching; please choose a size and a style that are comfortable for you and stop using an item if it causes discomfort or irritation.

Limit of our liability

To the extent permitted by law, we are not liable for indirect or consequential loss, such as lost profit or lost data, arising from the use of the website or from an item. Our total liability for any single claim connected with an order will not exceed the amount you paid us for that order. These limits do not apply where we have caused loss intentionally or through gross negligence, or where the law does not permit such a limit, including in relation to consumer contracts.

Privacy

We handle personal information as set out in our Privacy Policy and Cookie Policy. By sending us a message or placing an order you confirm that you have read them.

Governing law and disputes

These terms and any contract formed under them are governed by the laws of Japan. If a dispute cannot be settled by talking, the court with jurisdiction over our office in Niigata Prefecture will be the court of first instance, unless a mandatory law gives you the right to bring the case in the court of the place where you live.

Changes to these terms

We may update these terms when our services or the law change. The version that applies to an order is the one shown on this page when we confirm that order.
